Missed Opportunity? Appellate Court Asked to Reconsider $12.1M Judgment Collection Efforts

The Georgia Court of Appeals recently ruled in favor of Sovereign Healthcare Holdings, preventing Mariner Healthcare from collecting a $12.1 million judgment. 

Bondurant’s Chris Giovinazzo represented Sovereign Healthcare’s holding company and its executives, successfully defending against Mariner’s efforts to collect on assets transferred during Sovereign's insolvency. Mariner, determined to hold Sovereign's holding company and executives accountable for Sovereign's debts, argued the transfer of assets in 2005 was fraudulent and the holding company was liable. However, the Court found the statute of limitations had passed for fraud claims, ruling that Mariner should have raised those claims earlier.
