AG Carr can’t redo deal delaying executions, even if he’s ‘unhappy,’ judge rules

Attorney General’s Office argued COVID-era agreement to halt capital punishment until vaccines were available for ‘all’ members of the public is no longer applicable.

The Fulton County Superior Court recently granted summary judgment to Georgia’s capital defense bar, represented by Bondurant and Caplan Cobb LLC, in their suit to enforce a 2021 contract with the Georgia Attorney General’s office regarding the conditions for resuming executions post-COVID.

The court issued a permanent injunction, preventing the state from executing nine death-row prisoners until the contract’s conditions, including vaccine availability for all ages, are met.
