Winning Complex Litigation

Mickey Mixson of Bondurant Mixson & Elmore in Atlanta has made a career winning cases many other lawyers would consider “unwinnable.” So it was not a surprise when he was approached by Texas Businessman David McDavid about representing him in a Breach of Contract case for the sale of two professional sports franchises, the Atlanta Hawks and the Atlanta Thrashers, and the operating rights to Phillips Arena. The issue was that Mr. McDavid did not have a signed contract and the case hinged on whether or not an oral contract had been entered. After almost five years of litigation, including an eight week jury trial, Mickey and his team won Mr. McDavid a verdict of $281 million, which was affirmed on appeal.

In this presentation, Mr. Mixson will describe the interesting facts and legal theories about this case, how it was evaluated internally before we took the case, and some of the tactics used to win the case. The objective of this presentation is to help other litigators understand how to succeed in complex litigation where the quality of the lawyering can make or break the case.
